Section 60i Dispute Resolution Certificates and Parenting Mediation.

Before commencing parenting proceedings in the Federal Circuit and Family Court of Australia, parties are generally required to make a genuine effort to resolve their dispute through Family Dispute Resolution (FDR).

Family Dispute Resolution is a form of mediation specifically directed towards parenting disputes. It provides parents with an opportunity to discuss their concerns, identify areas of agreement and attempt to reach practical parenting arrangements without the need for Court proceedings.

If agreement is reached at mediation, the parties may formalise their arrangements by way of a Parenting Plan or, where appropriate, apply to the Court for Consent Orders.

Sayer Jones regularly represents clients in Family Dispute Resolution and private mediation, including complex parenting matters involving family violence, risk allegations, relocation and entrenched parental conflict. We can advise you before mediation, assist in developing appropriate parenting proposals, represent you throughout the mediation process and, where agreement cannot be reached, advise you about the next steps required to commence Court proceedings. We can also provide you with advice on whether your matter is likely to be exempt and where proceedings without a section 60I Certificate may be necessary.
