Family Violence.
Family violence is broadly defined and extends beyond physical assault. Family violence may include:
Physical or sexual abuse;
Emotional or psychological abuse;
Coercive control;
Financial control or economic abuse;
Threats, stalking or harassment;
Damage to property.
Family violence can affect parenting arrangements, Financial Settlements and personal safety.
The Court must prioritise the protection of children from harm and consider which arrangements best promote the safety of a child and person with care of a child.
Family violence is also considered in a Financial Settlement’s determination including in assessing contributions and a party’s current and future financial needs.
If family violence is ongoing, a Family Violence Intervention Order can be sought to protect a party and/or child (often referred to as Intervention Orders or Domestic Violence Orders).
