Arbitration.

Arbitration is an alternative dispute resolution process available to parties following a marriage or de facto relationship breakdown involved in financial disputes.

An arbitrator considers each party’s legal and factual arguments before issuing an arbitral award. The arbitral award can be registered with the Court to make it final and enforceable as a Court Order.

Whether private or Court ordered, parties must agree to participate in arbitration and agree upon the specialised Family Law arbitrator to be appointed.

Arbitration may be the preferred means of resolving property and spousal maintenance disputes particularly where flexibility, discretion, delay-avoidance and commercial sensitivity are important.
